Your privacy matters

This privacy policy (hereinafter called the “Privacy Policy”) is an integral part of the Terms and Conditions of the of the online store of DAMA Couture, i.e. damacouture.com (hereinafter the “Store”).

This Privacy Policy applies to individuals accessing the Store or using any channel of communications with the Store (hereinafter the “Client”).

The Store may collect and process the following data, i.e. name, address, e-mail, telephone, location, bank and credit card details, order history, size, IP address, browser ID and a website behavior (hereinafter the “Data”). The list is not exhaustive, and the Store may collect and process any data that is useful for its services. Not all Data is collected and processed for every Client. Often the Data is limited to a few details only. The Data collected is dependent upon the purpose of processing.

The Store does not collect and process sensitive data such as ethnic and racial origins, etc.

The Data may be collected from the Clients or their devices, the social media pages associated with the Store, customer service emails, newsletters, and the purchase transactions. The Store can also collect Data from third parties like public databases, third party processors or social media operators.

List of third parties the Store share their Data with are, but is not limited to, advertising platforms like Facebook, Instagram, Google Ads, statistical data collectors like Google Analytics, Google Tag Manager, HotJar, courier services companies like InPost, UPS, GLS, DHL, e-mailing companies like Klaviyo, SalesManago, GetResponse, and production management systems like IDEAerp.

The Store processes the Data only for the period in which it has the legal basis to do so.

The Store uses the Data to respond to the Client’s questions, to complete orders, for development and improvement of products and services, to comply with law and regulations, to connect with the Clients through social media, to show personalised advertisements.

The Store may use the Data to fulfil the legal grounds of a contractual obligation, legal obligation and to prepare, defense or exercise legal claims and in general where the Store has a legitimate interest to doing so. The Store may also store data which is given through consent. The Data is always handled with due care and in accordance with the applicable laws. The Store use data no longer than necessary and allowed in accordance with the applicable laws.

The Store will process the Data that is necessary for the performance of its contractual obligations. The Store may store specific financial data for a period of time to meet requirements set by the tax authorities. The Store may also process your data for the purpose of a legitimate business interest such as to strengthen our relationship with the Clients. The Store may provide the Clients with communications regarding its services that it thinks might interest the Clients.

The Store may process personal data when consented to do so. The Store asks the Clients for consent to send newsletters. The Store also asks permission to place a cookie on devices in order for the Store to set up profiles and place ads. When the Store processes data based on these legal grounds, the Clients have the right to object, restrict, erase, access and ask data portability.

The Store takes appropriate and reasonable organizational and technical security measures in order to ensure the safety of the Data. The Store does not process data to third parties unless it is allowed under the applicable laws, for example consent is given or if it is required by law. The Store employees are trained to handle the Data with care and strict confidentiality.

Cookies are pieces of information that the Store website sends to a device of the Client while the Client is browsing the Store website. The cookies help the Store to improve services, analyse the activities and to personalize the individuals experience (e.g. show the right language version, etc.). The cookies will stay on a device until the Client stop browsing (the “session” cookie) or until they expire or are deleted (the “persistent” cookie).

In most cases the Store will need consent to use cookies on the website. The exceptions are where the cookie is essential for the Store to provide a service that is requested, or essential to the inherent functionality of the website (e.g. to enables to store items in a shopping basket and/or to use our check-out process).

There are generally three categories of cookies: functional, analytical, marketing. The Store uses all three categories of cookies. The functional cookies are required to let the website function, as they allow website to remember the preferred language, etc. The analytical cookies allow to monitor the performance of our website and helps the Store to understand how the Client interacts with the website. The marketing cookies are used for the marketing purposes.

Third parties may have the ability to place the cookies on the website of the Store for the advertising purposes. Our third parties are Facebook and Google. The list is not exhaustive and may be changed without a notice. The Client has the ability to request access, restriction, portability, erasure, rectification of your personal data and file a complaint regarding their data subject rights by sending an email to hello@damacouture.pl The Store shall respond to the Client within 30 days.

The cookie policy can be amended from time to time. The most up to date version is published on the website of the Store.
